Copyright statements on websites containing Creative Commons licensed material
Where Creative Commons licensed material is being downloaded from a website, the terms contained in the licence for that material are intended to supersede the general terms on the website. It is important that agencies review copyright statements on websites offering licensed material and amend the copyright statement to reflect this. The following is a sample copyright statement that covers the inclusion of Creative Commons licensed materials (the situation of Creative Commons licences being applied is addressed in paragraph two):
Copyright
The Queensland Government supports and encourages the dissemination and exchange of information. However, copyright protects material on this website.
Where specific licence terms are applied through or via this website to material including a particular product those licence terms shall prevail over any inconsistent provisions on this website, including the provisions set out below. Where specific licence terms apply there is no need to contact the Copyright Contact Officer unless the proposed use of the material (including a particular product) is other than the uses authorised under the terms of the licence—or under the fair-dealing provisions in the Copyright Act 1968 (Commonwealth).
The Queensland Government has no objection to material on this website being reproduced, or made available online or electronically. However, the Queensland Government asserts the right to be recognised as author of original material and to have this material remain unaltered.
Copyright of Queensland Government materials resides with the State of Queensland. Apart from any fair dealings for the purposes of private study, research, criticism, or review as permitted under the Copyright Act, no part may be reproduced or re-used for any commercial purpose without written permission from [Department Name].
As far as practicable, material for which the copyright is owned by a third party will be clearly labelled. The Queensland Government has taken all reasonable efforts to ensure that this material has been reproduced on this website with the full consent of the copyright owners.
