Gender in Queensland Census Bulletin 1

Overview


The Office of Economic and Statistical Research (OESR), Queensland Treasury conducted a licensing review of their first Census 2006 Bulletin, “Gender in Queensland Census 2006 Bulletin 1”. This was to apply a GILF licence and to encourage the creative re-use of this information. It is important to note that this bulletin was published before the ABS deciding to license the majority of its website material under a Creative Commons licence.

The inputs to this bulletin are:

  • Original content – analysis and drafting undertaken by the Queensland Regional Office, Australian Bureau of Statistics (ABS) under a service arrangement with the Office of Economic and Statistical Research, Queensland Treasury.

  • Australian Bureau of Statistics (ABS) census data freely available on the ABS website.

  • ABS customised data of the Census of Population and Housing for census years before 1996. This data is not published on the ABS website and is only available via a consultancy arrangement with the ABS.

The importance of this case is to understand that while the ABS was contracted by OESR to write the original content, OESR is the rights holder of this original content, as agreed in the service agreement. When conducting a licensing review, it is essential to refer back to any original contracts, agreements or licences to ensure that their terms are respected.

1. Identification of material to be licensed

 

In this case, the Office of Economic and Statistical Research is both the creator and the publisher.

2. Identification and review of restrictions applicable to the original content

 

A review of the original content determined there were no restrictions on OESR to publish the original content via the OESR website.

3. Identification of the input sources used in the creation of the material

 

The bulletin’s inputs are:

    • Australian Bureau of Statistics (ABS) census data freely available on the ABS website.

    • ABS customised data of the Census of Population and Housing for census years before 1996. This data is not published on the ABS website, and is only available via a consultancy arrangement with the ABS.
       

4. Identification and review of publishing restrictions that apply to inputs

The licensing review of the first input determined that there were no restrictions on OESR, and it was able to publish the freely available ABS census data, which was incorporated in the bulletin.

However, for the second input (the customised data), OESR was presented with a problem. The ABS customised data was provided to the Queensland Government under a special arrangement called ABS@. During the initial review, it was not certain whether this input was free from publishing restrictions.

In consultation with the ABS, OESR reviewed the original ABS@ agreement and determined that ABS@ data could be included as an input without publishing restrictions.

This example highlights the importance of going back to the rights holder to ensure that no publishing restrictions exist, even if the rights holder is your organisation. It is also important to notethat if inputs are created under a former arrangement, negotiations with the Rights Holder are required to clarify the right.

5. Selection of GILF Licence


As the original content was licensed CC-BY, and inputs to the bulletin were found to have no publishing restrictions, OESR were able to select from the full suite of GILF Licences. In line with the GILF policy of licensing public sector material under the least restrictive terms, and to encourage its re-use, OESR chose to apply the preferred CC-BY licence to this bulletin.
